Media & Telemetry
Participants consent to official course photography and publication of official chip-timed split results on public leaderboards.
Governs all registrations, payments, spectator entries, athlete participations, and organizer operations on Raceras.
Introduction & Acceptance of Terms
Welcome to Raceras ("Raceras", "we", "us", or "our"), operated by Raceras Web Portal Services. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "Athlete", "Participant", or "Organizer") and Raceras governing your access to and use of our website, mobile interfaces, event registration checkout, timing results portals, and associated digital services.
By browsing our site, creating an account, submitting a race registration, paying for event fees, or utilizing our race management software, you represent that you have read, understood, and agreed to be bound by these Terms and our companion Privacy Policy. If you do not agree to all provisions of these Terms, you must immediately discontinue use of Raceras.
Platform Role as Intermediary & Commercial Collection Agent
Raceras Web Portal Services operates strictly as a technology platform, ticketing marketplace, software service provider, and authorized commercial collection agent for independent third-party event organizers ("Event Organizers"). Raceras is not the organizer, promoter, race director, owner, or course manager of events listed on the platform, unless explicitly designated in official event collaterals.
- Independent Event Organizers: Organizers are solely responsible for obtaining LGU road permits, police clearances, traffic management, route barricades, hydration stations, medical ambulances, course design, prize monies, and event safety protocols.
- Merchant of Record: The respective Event Organizer is the primary seller and merchant of record for race slots, race kits, finisher medals, and physical race execution.
- No Guarantee of Course Conditions: Raceras does not inspect race roadways or verify pavement quality, and disclaims all liability for road surface defects, vehicle incursions, or inclement weather hazards occurring during events.
User Accounts, Eligibility & Minor Registrations
Certain features, including club registrations, virtual run Strava linking, and organizer dashboards, require registering an authenticated account.
You agree to provide true, accurate, current, and complete information during registration (including full name, birth date, and emergency contact details). Falsification of birth dates or gender categories to gain competitive advantage in age-bracket awards constitutes fraud and results in immediate disqualification without refund.
Minors may participate in sanctioned categories only when registered by a parent or legal guardian. The parent or legal guardian certifies that they have read and voluntarily execute the Athletic Waiver on the minor's behalf, accepting all financial and physical responsibilities.
You are solely responsible for maintaining the confidentiality of your credentials. Raceras is not liable for unauthorized access resulting from your failure to protect login tokens or registration confirmation codes.
Event Registration & Custodial Pass-Through Entry Fees
When an athlete registers for an event through Raceras, funds collected at checkout operate strictly under a fiduciary and custodial structure:
All event registration and category entry fees are established directly by the Event Organizer. Raceras collects these entry fees in a custodial / collection agent capacity. These funds are held in trust in segregated disbursement accounts for remittance to the Event Organizer and do not constitute revenue or gross sales of Raceras.
- Disbursement to Organizers: Custodial entry fees are disbursed to verified organizer bank or merchant accounts net of agreed technology fees and gateway deductions.
- Event Slot Guarantees: A race slot is officially reserved only upon generation of a valid Registration Code following successful gateway payment authorization. Unpaid reservations expire automatically after the organizer's checkout timeout.
Payment Structure, Fee Breakdown & BIR Invoicing
Transactions conducted on Raceras comply with the regulations of the Bureau of Internal Revenue (BIR) of the Philippines:
Remitted directly to the Event Organizer for race kit entitlements, medals, road closures, and event production.
Paid to Raceras for software infrastructure, digital bib generation, server bandwidth, payment gateway integration, and customer support.
Tax & Official Invoicing: In compliance with Bureau of Internal Revenue (BIR) regulations governing registered commercial collection agents and online ticketing platforms, Raceras accounts for taxes solely on its Platform Convenience and Processing Fees. Raceras issues official electronic invoices covering these convenience fees. Invoices or official receipts covering the gross event registration / entry fee remain the exclusive tax responsibility of the respective Event Organizer.
BIR Registered Platform: Pursuant to BIR requirements for online platforms and digital business operations, the official BIR Registration Seal Badge is exhibited on the Raceras platform (accessible via the site footer).
Payment Gateways: Payments are processed via licensed aggregators (such as PayMongo and Xendit) supporting credit cards, GCash, Maya, and over-the-counter payments. All pricing is displayed and settled in Philippine Peso (₱).
Refunds, Cancellations, Postponements & Transfers
Because entry fees are pass-through funds held for Event Organizers, refund and modification policies operate as follows:
Refund terms, postponement policies, and medical withdrawal compensations are governed exclusively by each Event Organizer's published event regulations. Any refund requests must be submitted to and approved by the Event Organizer.
Platform convenience, technology, and payment processing fees cover completed electronic services and gateway costs. They are strictly non-refundable once a transaction is successfully settled, even if the underlying event is cancelled or postponed by the Organizer.
Transferring a race slot to another athlete or changing distance/category waves is subject to the Organizer's rules, transfer deadlines, and any applicable administrative re-assignment charges.
Athletic Participation, Assumption of Risk & Safety Waiver
You acknowledge that competitive road cycling, criteriums, peloton racing, endurance running, duathlons, and multisport competitions are strenuous athletic activities carrying inherent risks of serious bodily injury, permanent disability, paralysis, viral illness, heat stroke, cardiac arrest, collision with vehicles or course barriers, road surface hazards, and death. You knowingly, freely, and voluntarily assume all such risks.
1. Physical Fitness Warranty: You certify that you are medically fit, properly trained, and have not been advised otherwise by a licensed medical practitioner. You agree to immediately retire from the race course if you experience dizziness, chest pain, or debilitating symptoms.
2. Mandatory Cycling Safety Equipment: For all cycling and duathlon events, you must wear a certified, properly fitted safety helmet at all times when mounted on a bicycle. Bicycles must be mechanically sound with functional brakes. Failure to wear mandatory safety gear results in immediate disqualification by race marshals.
3. Emergency Medical Authorization: In the event of a crash, collision, or medical distress on the course, you hereby authorize on-site paramedics, medical teams, and hospital personnel to administer necessary emergency first aid, treatment, and medical transport. You acknowledge that expenses incurred for external medical care are your personal responsibility.
Media Rights, Photography & Public Results Consent
By entering a sanctioned race venue and participating in events registered through Raceras, you grant the following rights:
You grant Raceras and the Event Organizer the irrevocable, royalty-free, worldwide right to capture photographs, audio, video footage, and drone perspectives of you during the event, and to publish or broadcast them in photo galleries, broadcast streams, marketing reels, and sponsor collaterals without royalties or remuneration.
You agree that your name, allocated race bib, gun start, intermediate split times, chip finish time, category rank, and club affiliation will be publicly published on /results and archived for official sporting record keeping.
Virtual Runs & GPS Telemetry Regulations
Participants in virtual runs choose their own dates and courses. The following special regulations apply:
- Pedestrian Safety & Course Selection: Virtual runners/cyclists choose their own routes and are solely responsible for obeying local pedestrian laws, traffic lights, and sidewalk regulations. Raceras assumes no liability for route hazards chosen by virtual participants.
- Authentic GPS Verification: Activities synchronized via Strava, Garmin, or GPX uploads must be genuine, uninterrupted athletic performances by the registered participant during the open challenge period.
- Disqualification for Telemetry Manipulation: The use of motorized vehicles, electric pacing, speed manipulation, or altered GPX files will result in immediate disqualification and forfeiture of finisher medals.
Race Kit Claims, Merchandise & Courier Fulfillment
Depending on the event configuration, race kits (bib, timing chip, singlet) are claimed on-site or dispatched via courier:
On-Site Race Kit Claiming: Participants must present their digital Registration Barcode / QR Code along with a valid government ID. Authorized representatives must present an authorization letter and copies of valid IDs.
Courier Shipping (J&T Express / Third-Party Couriers): When selecting kit delivery, athletes must ensure complete delivery addresses. Raceras is not liable for failed deliveries resulting from inaccurate contact details or unserviceable address zones. Damaged parcels should be reported within 48 hours of receipt.
User Conduct & Fair Play
You agree to use Raceras with integrity and sportsmanship. You agree not to:
Intellectual Property & Proprietary Algorithms
The Raceras platform, including but not limited to the website design, software architecture, ApexVision bib-indexing workflows, brand identity, mascot illustrations, logos, and digital timing interfaces, are the proprietary intellectual property of Raceras. You may not copy, reverse-engineer, modify, or create derivative works without express prior written consent.
Limitation of Liability & Force Majeure
To the maximum extent permitted by Philippine law:
Total Liability Cap: In no event shall the aggregate liability of Raceras arising out of or related to your use of the platform exceed the total amount of Platform Convenience Fees actually paid by you to Raceras for the transaction in dispute.
Disclaimer of Indirect Damages: Raceras is not liable for punitive, indirect, incidental, or consequential damages, loss of prize monies, travel expenditures, or hotel bookings.
Force Majeure: Raceras is not liable for performance delays or event cancellations caused by events beyond reasonable control, including typhoons, floods, earthquakes, volcanic eruptions, armed conflicts, epidemics, road closure revocations by local government units (LGU), or telecommunication failures.
Indemnification
You agree to defend, indemnify, and hold harmless Raceras, its founders, officers, directors, software developers, and operational agents from and against all claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable attorney fees) arising out of or relating to: (a) your violation of these Terms; (b) your participation in any sporting event listed on the platform; (c) your breach of applicable traffic or civil laws; or (d) your violation of the rights of any third party.
Governing Law & Philippine Jurisdiction
These Terms and all disputes arising out of your relationship with Raceras shall be governed by, construed, and enforced in accordance with the substantive laws of the Republic of the Philippines, without regard to its conflict of law rules.
Any legal action, suit, or proceeding arising under or related to these Terms shall be instituted exclusively in the proper courts of the Philippines, and the parties hereby submit to the personal and subject-matter jurisdiction of such courts.
